Break the Addiction Local Challenge
Official Rules

           

1. Challenge Overview:
The Break the Addiction Local Challenge (the “Challenge”) is an eco-competition co-sponsored by Campus Climate Challenge (“CCC”), MTV Networks, a division of Viacom International Inc. (“MTVN”) and Time Warner Cable Inc., Cox Communications Inc., Cablevision Systems Corporation,
Bright House Networks LLC cable service providers  (each a “Cable Service Provider” and together with CCC and MTVN, the “Sponsors”) to challenge selected high school and college-age students in each of the Cable Service Providers’ local markets to demonstrate environmental changes or actions in their own lives and in their schools by empowering young people to make daily choices that improve their life and simultaneously curb the impact of global warming and preserve the environment.

2. Eligibility / To Enter:
Each Cable Service Provider, in connection with MTVN, shall select up to ten groups of at least three people per group and one administrator (each, a “Selected Group”) in each of their respective local markets to be eligible to participate in the Challenge and be eligible for prizing.  Each member of a Selected Group must be a legal resident of the United States, at least 13 years of age at time of entry and currently enrolled in a public high school or post-secondary institution (which includes any university, college, community college or technical school) in one of the Cable Service Providers’ local market.  Minors in the state of residence who are part of a Selected Group must obtain parental or legal guardian consent to participate in the Selected Group and the Challenge.

The Selected Group must register as a member of a local Campus Climate Challenge group which is a local, youth-lead group working to bring clean energy to their campus and local community on www.climatechallenge.org  (the “Website”) prior to entering the Challenge. The requirements for registering a Selected Group include providing contact information for yourself and at least two other student leaders on the online registration form which can be accessed by visiting the Website and clicking on “Join” link at the top of the homepage (“Registration” and with the submission requirements listed below, collectively a “Submission”). There is no cost to register your Selected Group. However, if a registered Campus Climate Challenge group already exists on your campus you must work with that group to submit your entry to the Challenge. Click on the “Find a Group” for a list of registered Campus Climate Challenge groups and more information about such groups on the Website. VOID OUTSIDE OF THE UNITED STATES AND WHEREVER PROHIBITED OR RESTRICTED BY LAW. 

Each Selected Group’s School must consent to such Selected Groups’ participation in the Challenge and agree to these Official Rules in order for the Selected Group to participate. Selection of the winning Groups and the awarding of the prizes is conditioned upon the cooperation of the potential winning Group’s school and prizing shall be awarded in the name or to the benefit of the winning Group’s school. 

Employees (and the members of their immediate families and households) of MTVN, CCC, Time Warner Cable Inc., Cox Communications Inc., Cablevision Systems Corporation, Bright House Networks LLC local markets and each of their respective parent, subsidiary and affiliated companies, sponsors, advertising agencies or any person who has won a CCC or MTVN National sweepstakes or contest in the twelve month period preceding the start date of the Challenge are not eligible to participate or win a prize.  By participating in this Challenge, entrants agree to be bound by these Official Rules and by the decisions of Sponsors, which are final in all matters relating to this Challenge.

3. Submission Requirements and Deadlines:

The Challenge commences at 12:01a.m. (ET) on January 16th, 2007 and ends at 11:59 p.m (ET) on March 15, 2007 (‘Entry Period”)

During the Entry Period, Selected Groups must submit evidence of both their educational activities and of their policy advocacy activities per the following guidelines:

  • Educational activities: Selected Groups must submit press coverage of their activities and accomplishments with respect to the speed and efficacy in which they have reduced their school’s global warming pollution.

 

All materials must be dated.

Acceptable forms of coverage include: a campus newspaper; local or national daily newspaper; national news weekly magazine; or a local or national network television spot (local access TV does not apply). 

To be considered, you must submit either a jpeg, tiff, pdf file, or a URL that links to an electronic version of a print article or TV clip.  The coverage must be about an actual activity or set of activities that your student group has done or is planning to do to stop global warming, and must mention your student organization’s name.

Selected Groups can evidence success in this area by submitting materials (event flyer, article in local or school paper etc.) that demonstrate the scope and impact of their activities. Acceptable activities might include:

1)      Energy saving competitions in the dorms, fraternities and sororities,
2)      Clean car shows on the quad or front lawn,
3)      Film screenings of environmentally-conscious movies,
4)      Solar powered events, such as smoothie making parties, “my clean dorm room”, latte giveaways, and concerts and
5)      A speaker’s series about global warming

  • Policy Advocacy

Selected Groups must be able to document the passage of a school-sanctioned policy that will reduced global warming pollution at their respective schools. Any policies that can be credibly argued to reduce global warming pollution achieved during the current academic year are eligible to win. Selected Groups must submit a copy of the actual policy, along with proof that the policy has been approved by school officials. This information will need to be verified by the school’s administration. Submissions for the Final Exam must be in the form of a jpeg, tiff or .pdf file or a URL that links to an electronic version of the policy and agreement.

Entries shall not contain, include or involve any of the following:

  • Obscenity.
  • Crude, vulgar or offensive pictures, depictions, images, language and/or symbols.
  • Gang signs or symbols.
  • Gratuitous violence, gun or other imagery or gestures of weapons.
  • Nudity.
  • Explicit, graphic or excessive sexual activity.
  • Commercial products (e.g., clothing, toys, food) and/or their trademarks, brands or logos.
  • Hard liquor use or product images.
  • License plates, phone numbers, personal addresses – physical or email or otherwise.
  • Website or web page links.
  • Illegal drug or alcohol use or abuse.
  • Derogatory characterizations of any ethnic, racial, sexual or religious groups. humiliate other people (publicly or otherwise), any assault or threatening of others
  • Trespass or the violation of other people’s rights or property.
  • Illegal (e.g., discriminatory, harassing) or inappropriate activity, behavior or conduct (e.g., inflicting emotional distress).
  • Conduct or activities in violation of this Agreement.
  • Any other content, display, materials and/or images that is or could be considered inappropriate, unsuitable or offensive, as determined by MTVN, in its sole discretion.

In submitting an entry into this Challenge, each member of a Selected Group agrees to, confirms and represents to MTVN that neither he/she nor anyone else has engaged or taken part in (or induced or encouraged anyone else to do so) in any activity or conduct in connection with this Challenge that (i) may or is likely to harm or create a risk of harm, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to any person, other living thing or any property, (ii) may or is likely to create a risk of any other loss or damage to person, living things or property, (iii) is or may constitute a crime, unlawful or non-consensual activities (e.g., conduct that could lead to criminal prosecution), tortious conduct (e.g., conduct that could lead to civil prosecution) or the violation or infringement of the rights of any other party or (iv) violates any of the terms or conditions of these Official Rules. MTVN is not obligated to review, consider, use, publish, display or broadcast any materials submitted with an entry, however, each Selected Group acknowledges that MTVN will rely on such individual’s agreement and compliance with these Official Rules when you submit or attempt to submit materials to the Challenge.  MTVN (and any and all of MTVN’s subsidiaries and affiliates and affiliated broadcast stations and networks), shall have the right to use any materials submitted pursuant to these Official Rules on any MTVN program, programming channel, broadcast or other public display and performance, at any time in the future, without notice and without compensation, royalty, accounting, liability or obligation of any kind to any member of the Selected Group. CCC shall have the right to use any materials submitted pursuant to these Official Rules in or on the Web Site at any time in the future, without notice and without compensation, royalty, accounting, liability or obligation of any kind to any member of the Selected Group.
Each Cable Service Provider shall have the right to use any materials submitted pursuant to these Official Rules on any Cable Service Provider program, programming channel, broadcast or other public display and performance, at any time in the future, without notice and without compensation, royalty, accounting, liability or obligation of any kind to any member of the Selected Group.
MTVN reserves the right to reject any entries that it deems, in its sole discretion, to violate any of the policies of MTVN’s “Standards and Practices Guidelines.” MTVN may modify or edit any materials related to the Challenge or request entrants to do so, so that such materials meet such guidelines.

Completed entries, submitted in accordance with these Official Rules and within the above-mentioned deadlines guidelines shall collectively be referred to herein as the “Eligible Entries”.

6. Judging Criteria/Winner Selection:

The judging panel in each local market will consist of representatives of CCC and MTVN, and the Cable Service Provider in that market( the “Judges”). The Judges will review all Eligible Entries and determine winners based on the following criteria:

 

The Judges will review all Eligible Entries received and determine winning Selected Groups (the “Grand Prize Winners”). Selected Groups will be judged on how well they did in two categories: (a) Conducting activities that educate and engage their student body about global warming solutions and/or (b) Getting their school to adopt policies to reduce their school’s global warming pollution and More specifically, Selected Groups will be judged on the extent to which the policy ensures a reduction in their campus’ global warming pollution, has a concrete timeline for implementation, includes at least one immediate action in the next academic year and includes students in the decision-making.

The Judges reserve the right to conduct phone interviews with some or all of a participating Selected Group’s members and/or a representative from the Group’s school during the judging process.

There will be one Grand Prize Winner selected in each of the Cable Service Provider’s local markets. Grand Prize Winners will be announced on or around April 22, 2007. Sponsors will contact the potential winners within ten 10 days of winner selection by telephone and/or email. Sponsors will make up to three (3) attempts to contact the potential winners during this timeframe. Upon notification potential Grand Prize Winners’ School administrators will be required to furnish proof of identity and eligibility, including, without limitation, a valid government-issued photo ID and/ a school ID. If any school administrator of a potential Grand Prize Winner’s school is unreachable, fails to prove identity and eligibility within the timeframe specified by Sponsors or does not comply with these Official Rules then an alternate potential Grand Prize Winner may be selected by Sponsors in accordance with the judging process set forth above. Sponsors in their sole and unequivocal discretion, expressly reserve the right to delay the announcement of any of the winners. Determination of the final winners will be conditioned upon the winners’ respective schools’ acceptance of the prizes and the terms associated therewith.

7. Prizes:

      Each of the Grand Prize Winners will be awarded an MTV Eco-Kit for every student enrolled in that Grand Prize Winner’s school at time of entry (maximum up to 2,000) students consisting of eco-friendly tools to be determined valued at up to $10 per kit for a total value of $20,000 per school in each participating market as well as the chance to be considered for the National Break the Addiction Challenge (subject to the rules of the National Break the Addiction Challenge (http://climatechallenge.org/index.php?module=pagemaster&PAGE_user_op=view_page&PAGE_id=68) and a chance for their Group be featured in an MTV on-air news segment which is up to MTV’s sole discretion.

The tentative date for fulfillment of the prizes is approximately sixty (60) days following winner selection and verification but is subject to change at Sponsors’ sole discretion.  The prizes may not be substituted except by Sponsors in their sole discretion.  All details related to the prizes not specified herein shall be determined solely be Sponsors in their sole discretion.  Sponsors shall not be responsible for non-fulfillment of any prizes due to a school’s rejection or restriction of the same.

8. Miscellanous.

No responsibility is assumed for incorrect or inaccurate entry information whether caused by any of the equipment or programming associated with or utilized in this Challenge or by any human error which may occur in the processing of entries to this Challenge.  Sponsors are not responsible for any problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion or the Internet or at any web site or combination thereof, including injury or damage to participants or to any other person’s computer related to or resulting from participating or downloading materials in this Challenge.  If, for any reason, the Challenge is not capable of running as planned, including changes in MTVN’s or in Cable Service Providers on-air programming, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Challenge or for any reason Sponsors deem it necessary, Sponsors reserves the right in its sole discretion to cancel, terminate, modify, delay or suspend the Challenge due to any reason of a technical, creative or other nature. Submissions and/or entries that have been tampered with or altered are void.  In the event of a dispute over who submitted a winning entry, the holder of the winning email account will be declared the winner. All entries become the property of Sponsors and will not be returned.  By participating in this Challenge, each member of the Selected Groups acknowledge compliance with these Official Rules.

9. All interpretations of the rules and decisions by Sponsors are final.  Sponsors reserve the right, in their sole discretion, to disqualify any individual it finds or believes to be tampering with the entry process or the operation of the Challenge or the Website; to be acting in violation of these Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.  CAUTION:  ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CHALLENGE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT/INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.  THE NEW YORK COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE CHALLENGE AND THE LAWS OF THE STATE OF NEW YORK SHALL GOVERN THE CHALLENGE.  EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THESE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS.

10.             Arrangements for the fulfillment of the prizes will be made by Sponsors. Sponsors reserve the right in their sole discretion to substitute any and all prizes, with prizes of comparable value for any reason that it deems necessary.  All prizes are non-transferable.  School administrator, on behalf of the Winners must sign (a) an affidavit of eligibility and release of Sponsors, and their respective corporate parents, subsidiaries affiliated entities, advertising agencies, and any other participating partners and or advertisers, and their respective employees from any and all liability, claims, demands and causes of action for personal injury and/or damage, theft, loss, or any other harm suffered in connection with this Challenge or the use or acceptance of the prizes, or any portion thereof, to be eligible for the prizes; and (b) except where prohibited, a promotional release granting the right to use his or her name and likeness for advertising and publicity purposes without additional compensation. Additionally, Selected Groups may be required to provide references (upon request) that verify an entry’s accuracy.  Entry into this Challenge constitutes winners’ and the School Representative’s agreement to sign such releases.  Each member of a Grand Prize Winners and School Representatives must also complete any additional legal documents provided by Sponsors and return them to Sponsors within seven (7) days after receipt of such documents.  Noncompliance may result in disqualification.  ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER OR SCHOOL ADMINISTRATOR (AT MTVN’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS A WINNER OF “BREAK YOUR SCHOOL’S ADDICTION CHALLENGE” AND ALL PRIVILEGES AS A WILL BE IMMEDIATELY TERMINATED.  Upon receipt of a prize or any portion thereof, winners and their respective schools are required to comply with any and all applicable federal, state and local laws, rules and regulations in addition to any federal, state and local taxes which may become due with respect to the prizes they receive.

11.             Past experience has confirmed that contests and other competitions generate substantially similar submissions or entries that closely resemble concepts and ideas that have been independently developed by Sponsors before or after the Challenge. Accordingly, entrants may subsequently see an MTVN or CCC presentation that seemingly incorporates an idea or concept or includes materials similar to that contained in their entries. Any similarity is purely coincidental and unavoidable in light of the volume of ideas that MTVN routinely considers in the course of its program development. Because of this possibility, Selected Groups and their individual members hereby agree to submit their entries under the following terms and conditions: (a) that Sponsors may use any ideas, concepts, material, in whole or in part, contained in an entry; (b) that all materials submitted become the property of Sponsors and will not be returned; (c) that all materials submitted are free from any lien or claim by anyone, including, but not limited to any union, guild or performance rights society; (d) entrants have obtained all rights, permissions and licenses necessary to use their entry materials for any purpose; (e) that no entry or any part thereof infringes any trademark or copyright or otherwise violates anyone’s right of privacy or publicity; and (f) entrants indemnify and hold harmless Sponsors and their respective parents, subsidiaries and affiliated companies, sponsors and advertising agencies from any claims, suits, losses damages and expenses (including reasonable attorneys’ fees) that arise from any breach of the following conditions. All entrants agree to the foregoing and in addition agree to obtain, upon request of Sponsors and/or any documentation and releases necessary to prove their unrestricted ownership in all materials contained in their entries and their right to use such materials without limitation for any purpose. They further agree, if chosen as a winner, to assign all right, title and interest in all material and agree to sign such documentation as is necessary to formalize this assignment.

Notwithstanding the foregoing, entrants agree that their entry materials may be used by Sponsors in whole or in part for any purpose whatsoever without compensation to non-prize winner entrants.
